Personal Information We Collect and How We Use It

This section of our Privacy Policy describes the categories of personal information we collect about you and the different ways in which we collect your personal information as well as the different purposes for which we may use your personal information. The personal information we collect is comprised of the information you provide to us directly, information we receive from vendors or service providers we hire to work on our behalf, and information collected passively from your devices or your use of the Platforms using tracking technologies such as cookies, pixels, web beacons, and other automated data collection mechanisms consistent with our Cookie Policy.

Online Purchases: When you make a purchase on or through a Platform we will collect your name, shipping address, telephone number, email address, and payment information.
We use this information to process your order, ship the product you purchased, and communicate with you about your purchase. In addition, we may use this information to send you information, marketing, and other promotions about our products and services.Please note that when you provide payment information to us, we may or may not collect that information directly. When we collect your payment information directly, we only use such information to process your payment and otherwise in compliance with all PCI-DSS requirements. Where we have engaged a third-party payment processor to process payments on our behalf, which includes all purchases made through a Platform, your payment information is sent directly to our third-party payment processor who will only use such information for the purpose of processing your payment.
Platform Visits: If you visit our Platform, even if you don’t make a purchase, we may collect personal information via cookies and similar trackers.
In-Person Visits: When you visit certain GFS facilities, we may capture or otherwise collect photographs and record audio and video at the property (including through the use of CCTV cameras, AI-enabled cameras, and other technologies).
We use this information for the safety and security of our customers and employees, and to prevent, investigate, and prosecute shoplifting, fraud, and other criminal activities. Where this information is considered ā€œbiometric informationā€ or ā€œsensitive informationā€ under state law, we provide notice at the point of entry.
Support and Customer Service: If you call us, email us, or chat with us or our AI chatbots, we may collect your name, email address, and any other personal information you provide us in your communications. We record customer service interactions for quality control and to improve services.
We use this information to assist you and respond to your inquiries, requests, and other customer service related activities. We review data from customer interactions, including audio recordings and transcripts, to improve our services.
Marketing Communications: If you subscribe to our newsletters or marketing communications, including our text messaging service, or interact with our chatbots, we will collect your email address or other contact information. If you receive marketing communications directly from us, we will collect your name, email address, location, IP address, and track details related to your access and viewing of the materials, including the date and time you accessed the materials and the time spent viewing such materials.
We will use this information for the purpose of sending you our newsletter and other marketing in accordance with the consents you provided. We track your time spent accessing the marketing materials to better understand your interests and preferences with respect to our products and services.
Credit Applications: If you apply for financing for your business we will collect certain information about your business which may include personal information, particularly if your business is a sole proprietorship. Such information may include your name, address, telephone number, email, banking details, and driver’s license number. As part of the credit application, you will be required to expressly consent to us conducting a credit check which may result in our collection of additional personal information about your creditworthiness. Please note that this may result in a hard inquiry on your credit report, which may have a temporary negative impact to your credit score. You have the option of providing us your Social Security Number (SSN) as part of your credit application. The provision of your SSN is completely optional and will be used for identity verification.
We use this information to facilitate the provision of financing to your business, which includes using the provided information to confirm your identity, assess your credit application and, if your application is approved, administer your credit arrangement, which may include communicating with you about your credit arrangement and withdrawing payments from the designated account.
Applicants for Employment: If you are applying for employment with us we will collect certain personal information from you as part of the application process, which may include your name, address, email address, and any information provided on your cover letter and resume through our online portal or through the assessment and interview process when interacting with our AI chatbot HR assistant.
We use this information to consider you for employment with our company. If you are not selected for the position, we can retain your information to consider you for other positions, or you can request the deletion of your personal information by contacting us as detailed at the end of this Privacy Policy.
Inferences: Using other pieces of personal information collected about you, we may draw inferences about you.
GFS will use inferences to help us assess what we can reasonably believe to be your preferences, characteristics, and predispositions. We do not, however, use customer data or personal information to infer sensitive information, such as your health status, religion, or political affiliations, for the purpose of marketing or profiling.
Cycle Menu Management/NetMenu: If you are a customer that uses Cycle Menu Management/NetMenu, the information collected is subject to a separate agreement (called a Business Associate Agreement) and is not subject to this Privacy Policy.
Your personal information is used for the purpose of delivering menu and nutrition related services to you via the Cycle Menu Management/NetMenu Platform as further detailed in the Business Associate Agreement.

Cycle Menu Management/NetMenu: If you are a customer that uses Cycle Menu Management/NetMenu, the information collected is subject to a separate agreement (called a Business Associate Agreement) and is not subject to this Privacy Policy.

How We Use It

Your personal information is used for the purpose of delivering menu and nutrition related services to you via the Cycle Menu Management/NetMenu Platform as further detailed in the Business Associate Agreement.

In addition to the above, we may use some or all of your personal information as we believe appropriate to: (i) investigate or prevent violation of the law or your agreements with us; (ii) protect our, your, or others’ rights, privacy, safety or property (including by prosecuting and defending legal claims); (iii) protect, investigate, and deter against fraudulent, harmful, unauthorized, unethical, or illegal activity; (iv) comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities; and (v) where permitted by law in connection with a legal investigation.

Some of the information we collect may be considered sensitive information in certain jurisdictions, including, for example, (i) username and password; (ii) precise geolocation data; (iii) certain demographic information like gender, race/ethnicity, status as a visible minority and/or other legally protected enumerated grounds; (iv) union membership; government issued ID number; and health-related information.

How We Share Your Personal Information

This section of our Privacy Policy describes the categories of personal information we share with third parties and the types of third parties with whom we share that information.Ā  We may share your personal information with third parties for a number of reasons, as further described below.Ā  Unless otherwise indicated at the time we collect your information, if we allow third parties to access the personal information we collect, we will have contractual provisions or other appropriate protections in place to ensure such access is for limited purposes and in compliance with this Privacy Policy.

  1. Affiliates. We may disclose all of the personal information we have collected about you to any of our affiliates within the Gordon Food Service corporate group to the extent that these affiliates require such personal information and only employees or service providers of these affiliates which require such personal information to perform their duties will have access to it.Ā 
  2. Service Providers. We may disclose your personal information to our service providers who perform certain services necessary to run our business to the extent that they require such personal information to perform their duties.Ā Ā This information may include your contact information, payment information, communications, and cookie information. This may include service providers who send emails for us, help us manage and operate our Platforms, fulfill purchases, provide advertising or marketing services or place our advertisements on other platforms, product reviews, provide analytics, search engine support, track advertising impressions, investigate and prevent data incidents, provide physical and digital security services, audit our business and financial statements, vet job applicants, and provide legal advice. In certain instances, personal information received by our service providers may also be subject to their privacy policies.
  3. When Reasonably Required. We may disclose some or all of the personal information we have collected about you when we believe in good faith that disclosure is necessary to protect our rights or property, protect your safety or the safety of others, investigate fraud or respond to a government, judicial or other legal request, or to comply with the law. We may share any or all personal information to respond to a court order or subpoena. We may also share any or all personal information if a government agency or investigatory body requests it.
  4. Corporate Circumstances. We may disclose some or all of the personal information we have collected about you in connection with a corporate change or dissolution, including for example a merger, acquisition, reorganization, consolidation, bankruptcy, liquidation, sale of assets, wind down of business, application for loans, or as otherwise necessary for a prospective buyer, lender or bank, as the case may be, to conduct necessary due diligence of our business. If part of our business (including any of our affiliates, divisions, and business units) is acquired by a third party, we may include personal information as part of that transaction, which may include some or of your personal information. We may also share your information with others as they conduct diligence of our corporate changes.

We may share personal information for other reasons we may describe to you from time to time or as permitted or required by law.

Use of Cookies and Tracking Technologies

As is commonly done on websites, we may use automated data collections mechanisms such as cookies, pixels, web beacons, and other tracking technology (ā€œCookiesā€) to improve and market our Platforms, products and services and provide you with an enhanced user experience. We have partnered with select third parties, such as Google, which also place Cookies on our Platforms to collect and process information about our users for various purposes, including for security, for analytics, and to facilitate targeted advertising. This Platform recognizes Global Privacy Control (GPC) signals and will automatically opt you out of the sharing of your information if you have turned on such signals. Some browsers turn on GPC signals automatically, but you may need to configure your browser or use a browser extension to enable such signals.Ā 

Usage of Artificial Intelligence in Employment

GFS may leverage conversational artificial intelligence platforms (ā€œConversational AIā€) to enable natural language conversations with candidates for purposes of assisting in the employment application process. These platforms assist with identifying opportunities at GFS that may be a good fit for you based on your responses, including the personal information you provide to GFS in your employment application, to the Conversational AI. These platforms also assist us with scheduling interviews, uploading resumes, and related activities. For example, if you tell us that you live in a certain location, the Conversational AI may recommend employment opportunities near you. However, GFS does not rely on Conversational AI to substantially assist in making employment decisions. As always if you prefer to speak directly with human resources at GFS about your application, please contact us at: talent@gfs.com. As a matter of good practice, these platform providers regularly test platform functionality to ensure that their functionality do not have unknown biases that affect fairness of selection processes. Further, GFS routinely and regularly conducts internal reviews of these platforms and their outcomes to ensure that there are no unknown biases. Employment decisions are made by GFS’s leaders, not technology platforms.

Your Privacy Rights and Choices

This section of our Privacy Policy describes your rights and choices with respect to the personal information you provide and the marketing communications you may receive.

You are not required to provide all personal information, and you may delete certain personal information identified in this Privacy Policy to use our Platforms or to interact with us offline, but certain functionality will not be available if you do not provide personal information. For example, if you do not provide personal information or if you exercise your right to delete personal information, we may not be able to respond to your request, perform a transaction with you, or provide you with marketing that we believe you would find valuable.

NOTICE: We may engage in targeted advertising and share your personal information with third parties in connection with targeted advertising. You can opt-out of this practice as detailed below. We do not otherwise sell your personal information or process your personal information for the purposes of profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers. We may collect and share sensitive data about you as described in this Privacy Policy (for example, to consider you for financing or employment), but we do not sell your sensitive information or make sensitive data inferences in connection with our products and services. If we do so in the future, we will obtain your consent before doing so and we will provide you with more details at that time.

Under certain circumstances, such as those individuals residing in California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, you may have rights under data protection laws in relation to your personal information that we process. We have compiled a list of the privacy rights that you may have below based on where you live, but you may not be entitled to all of these rights, or you may have additional rights. Finally, there may be situations when GFS cannot grant a request, for example to complete a transaction for you or to comply with law. In all cases, GFS will do its best to honor your request.

  • Opt Out of Communications. You may opt out of marketing-related emails by changing the communication preferences in your account settings or by following the opt-out prompt in our emails. You may opt out of SMS messages by texting ā€œSTOP.ā€ To opt out of other forms of communications, please contact as detailed at the end of this Privacy Policy. Note that we may still need to contact you in some circumstances (for example, for legal purposes or in response to your direct requests)
  • Opt Out of Targeted Advertising. You may opt out of the processing and sharing of your personal information for targeted advertising. This Platform recognizes Global Privacy Control (GPC) signals and will automatically opt you out of this practice if you have turned on such signals. If you have not turned on such signals, you must turn off third-party advertising trackers on any device used to access the Platform to opt out of targeted advertising.   • Correct Your Information. You may request that we correct inaccurate personal information we maintain about you.
  • Delete Your Information. You may request that we delete certain personal information we have collected about you, with certain exceptions.
  • Access Your Information. You may have the right to confirm whether we are processing your personal information and to request access such personal information, including the third parties with which we share your personal information, and, under certain circumstances, to receive a copy of such personal information.
  • Withdraw Your Consent. You may have the right to withdraw consent to us processing your personal information.
  • Appeal Our Decision. As further described below, you may have the right to appeal (i.e., ask us to reconsider) our initial response to your privacy requests.

As required by law, you may be entitled to additional rights, including: (i) the right to control the dissemination of certain of your personal information; and (ii) the right to receive computerized personal information collected from you in a structured, commonly used and technological format and to have this information transferred directly to another organization (aka ā€œportā€ your information); and (iii) the right to request additional information about data processing.

Only you or an individual empowered by law to act on your behalf may make a request related to your personal information. To exercise your right to opt out, follow the instructions above. To exercise your other rights, or to make a complaint, please contact us at privacy@gfs.com or submit a data subject access or rights request here under the ā€œYour Rightsā€ tab. As part of your request, please specify which right you are exercising and be prepared to provide your name and contact information. After receiving your request, we will use the information you provided to authenticate your identity or your authority as an authorized agent. However, we may ask you to provide additional information if we cannot authenticate your identity or authority based on the information you have provided and the information in our records or inform you if we believe your request is fraudulent. We will not discriminate against you if you choose to exercise your rights.

We will try to respond to your request within 45 days and notify you if your request has been granted or declined, or if an exception applies to your request. If we need additional time, we will contact you with the reason and the extension period. We will deliver our written response by mail or electronically, at your option. Our response will also explain the reasons we cannot comply with any request, if applicable. We do not charge a fee to process or respond to your request unless your request is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate prior to completing your request.

You have the right to appeal our refusal to take action on a rights request after receiving our decision as detailed in our response or by contacting us as detailed at the end of this Policy. If you are a Nebraska resident you also have the right to appeal this refusal to the office of the Attorney General. We will try to inform you of our decision in writing within 45 days after receipt of your appeal, with a written explanation of our decision. If we need more time, we will contact you with the reason and the extension period. If your appeal is denied or if you have concerns about the results of an appeal, you may contact your state’s attorney general or your province’s data protection authority. We will provide their contact information with the results of the appeal.

Other Important Privacy Information
Transfers of Your Personal Information

We are headquartered in the United States. Please be aware that information you provide to us or that we obtain as a result of your use of our Platforms may be collected in your country and subsequently transferred to, maintained and processed in the United States by us or our service providers for the purposes mentioned above in accordance with applicable law. The privacy laws of the United States may not always offer the same level of protection as in your country. While such information is outside of your jurisdiction of residence, it is subject to the laws of the jurisdiction in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other jurisdictions, pursuant to local laws. By using our Platforms, you consent to the collection, international transfer, storage, and processing of your information in accordance with this Privacy Policy. Children

Our Platforms are intended for adults. We do not knowingly collect personal information from children under 18. If you are a parent or legal guardian and think your child has given us information, you can contact us as detailed at the end of this Privacy Policy.

How We Protect Your Information

At GFS we take the protection of your personal information seriously. We use standard security measures to store and prevent unauthorized use, disclosure, loss or theft of your personal information. Please be aware that the internet is not 100% secure and no data security measures can guarantee complete security. We cannot promise that your use of our Platforms will be completely safe. Any transmission of your personal information to or on our Platforms is at your own risk. We encourage you to use caution and to take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess and keeping your log-in and password private. If you do not want GFS to know any particular information about you, you should not include that information in anything you submit or post to the Platform.

Retention of Your Information

We will only retain your personal information as long as is necessary for the fulfillment of the purposes for which it was collected – including for the purposes of satisfying any legal, accounting, or reporting requirements – or as otherwise required by applicable law, after which time it is destroyed or rendered such that it is unable to identify you. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

Links to Third-Party Websites

This Platform may contain links to other websites not affiliated with GFS. Also, you may have come to this Platform from a website that is not operated by GFS. We are not responsible for the operation of these other sites or the information that they collect from their visitors. If you’d like to know how another site collects and uses your information, please review its privacy policy.

Chat Services

Our chat services (for example, Tess, Expo) may rely on AI and Generative AI (ā€œGenAIā€) agents and may have live agents. By engaging in a chat with these agents, you consent to and acknowledge that we and our service providers may keep a transcript of the chat and that we may utilize cookies and trackers consistent with our Cookie Policy. You can control your cookie preferences in our Privacy Center. GFS may analyze chat transcripts for quality control, training, to improve our services, and to provide you with advertising, marketing, and other promotions.

SMS Services

To sign up for our SMS or text and short messaging service and related marketing (ā€œSMS Serviceā€), you must provide us with your personal information, including your first name, mobile phone number, and email address. We will also receive the text of the messages you send to us and any user or screen name that you select in connection with the SMS Service. We may use a third-party service provider to provide the SMS Service, and your information will be shared with that provider. Your consent to the SMS Service is not a condition of purchase of any goods or services.

Blogs and Other Social Networking Mediums

If you use the blog feature on a Platform or if you communicate with us through any other social networking forum (for example, Twitter or Facebook), you should be aware that any personal information you submit through comments or posts to the blog or other social networking forum can be read, collected, or otherwise used by anyone with access to the forum or who visits the URL of the web page on which the post or comment is posted. The collection and use of your personal information on these websites is governed by their privacy policies. We are not responsible for non-GFS use of this information.

Privacy Policy Updates

From time to time, we may change this Privacy Policy. We will notify you of any material changes to our Privacy Policy to the extent required by law. We will post an updated copy on our Platforms. Please check our Platforms periodically for updates. Your continued use of a Platform means that you consent to the collection, use and disclosure of your personal information as set out in the updated Privacy Policy.
